摘　　要：党的十八大以来,习近平总书记多次强调:“要系统梳理传统文化资源,让收藏在禁宫里的文物、陈列在广阔大地上的遗产、书写在古籍里的文字都活起来。”活态传承是新时代做好非遗保护工作的实践要求,活态传承就是要在传承保护好非遗的基础上进行创新。保护知识产权就是保护创新,从方法论来说,用知识产权保护非遗,并不是一味地削足适履,而是要量体裁衣,专利、商标、商业秘密都为保护陶瓷非遗提供了可行路径。Since the 18th National Congress of the CPC,General Secretary Xi Jinping has emphasized many times that traditional cultural resources should be systematically sorted out,so that cultural relics collected in the forbidden place,heritage displayed across the vast land,and characters in ancient books can come to life.Living heritage transmission is required for the protection of intangible cultural heritage in the new era,with its target directed at innovations on inheriting and protecting intangible cultural heritage.Protecting intellectual property rights equals protecting innovations.However,methodologically,protecting intangible cultural heritage by intellectual property rights doesnt mean acting in a Procrustean way,but acting according to actual circumstances,because patents,trademarks and trade secrets can all provide a practical path to the protection of intangible ceramic cultural heritage.
