新《中华人民共和国行政处罚法》第二十九条适用机制探究

摘　　要：新《中华人民共和国行政处罚法》第二十九条对“一事不二罚”原则做出了更为详细的解释,即“……同一个违法行为违反多个法律规范应当给予罚款处罚的,按照罚款数额高的规定处罚”,该内容又被称为“一事不再罚”。当前,我国行政处罚理论不断完善,处罚法定、过罚相当等方面已有长足进步。但在司法实践中,关于该条款的适用仍存在最高罚款金额确定不清晰、立案在先与从重处罚冲突等问题。对此,通过对想象竞合、主体竞合等情况进行分类讨论,提出最高罚款金额的确定方法,并构建协调“择一重处罚”与“立案在先”的适用方案:借助事前全面协商管辖制度、行政处罚询问确认制度和救济补正制度,以完善我国行政处罚体系中“一事不二罚”原则的适用。Article 29 of the new Administrative Punishment Law of china provides a more detailed explanation of the principle of"no double punishment for the same offense,"stating that"...if a single illegal act violates multiple legal norms and is subject to fine penalties,the provision stipulating the highest fine shall apply."This principle is also known as"no double punishment for the same act."Currently,China's administrative punishment theory has continuously improved,with significant progress in aspects such as statutory punishment and proportionality.However,in judicial practice,issues such as unclear determination of the maximum fine and conflicts between the principle of"first-filed case prevails"and aggravated punishment still persist in the application of this clause.To address these issues,this paper categorizes and discusses situations such as imaginary concurrence and subject concurrence,proposes methods for determining the maximum fine,and suggests a coordinated application scheme for"selecting the most severe punishment"and"first-filed case prevails."This can be achieved through the establishment of a pre-comprehensive consultation jurisdiction system,an inquiry and confirmation system for administrative punishments,and a relief and rectification system,in order to improve the application of the"no double punishment for the same offense"principle in China's administrative punishment system.
