论失能老年人监护制度的完善

摘　　要：在人口老龄化背景下,更为严峻的挑战是失能老年人权益的保障。监护制度是积极应对老龄化的重要举措之一,能够从法治层面弥补传统家庭式养老功能的弱化、弥合失能老年人之“失能”特征的照护、充实失能老年人养老保障的力量。当前失能老年人监护制度存在法定监护适用主体和类型单一、意定监护内容不够细化、监护监督制度缺失等不足之处。借鉴域外经验,出台针对失能老年人权益保障的监护专项法规,丰富监护主体范围和类型,细化意定监护的内容,构建全过程监护监督制度。As our population ages,safeguarding the rights and interests of disabled elderly individuals has become increasingly challenging.The guardianship system is a crucial measure for actively responding to the needs of an ageing population.It compensates for the declining ability of traditional family care structures by providing legal support that addresses the“disability”characteristics of disabled elderly individuals,ultimately enhancing their care and security.Currently,there are shortcomings in the guardianship system for disabled elderly individuals,such as a limited variety of legal guardianship options,insufficient clarity in the specified guardianship content,and a lack of a comprehensive guardianship supervision system.To improve this situation,we can draw on international experience,introducing special regulations on guardianship to protect the rights and interests of disabled elderly individuals,expanding the range and types of guardianship subjects,refining the content of designated guardianship,and establishing a thorough guardianship supervision process.
