体系化视野下的民营经济立法与完善

摘　　要：民营经济专项立法将现有的方针政策和有效做法上升为法律,有利于发挥立法保障民营经济高质量发展的积极作用。当前《中华人民共和国民营经济促进法(草案)》明确了层次性的立法目的、确立了立法思路与原则、搭建了关键的制度框架,具有统筹立法与政策关系、坚持实体与程序并重、夯实民营经济发展的法律基础等亮点。但从立法体系化的角度审视,该草案还存在内在逻辑性问题与外部协调性问题。为此,应优化草案内在逻辑性,遵循“从原则到规则”“由内到外”“先保障后促进”的理念,完善立法目的、篇章结构和促进措施;应提升草案的外部协调性,优化立法权配置,通过多层次立法落实法律规定与鼓励地方先行先试,从而为民营经济高质量发展、做大做强提供强有力的法治保障。The special legislation for the private economy elevates existing policies and effective practices into law,playing a positive role in legislation to ensure the high-quality development of the private economy.The current draft version of the Private Economy Promotion Law clarifies the hierarchical legislative objectives,establishes legislative ideas and principles,and builds a key institutional framework.It has highlighted such as coordinating the relationship between legislation and policy,emphasizing both substance and procedure,and consolidating the legal foundation for the development of the private economy.However,there are still internal logical and external coordination issues with the draft from the perspective of legislative systematization.To this end,the internal logic of the draft version should be optimized,following the logical sequence of“from principles to rules”,“from inside to outside”,and“from protection to promotion”,and improving the legislative purpose,chapter structure,and promotion measures.It is suggested to enhance the external coordination of the draft version,optimize the allocation of legislative power,implement legal provisions through multi-level legislation,and encourage local governments to take the lead,in order to provide strong legal guarantees for the high-quality development and growth of the private economy.
