跨境信用治理:基于信用数据双重属性的分析

摘　　要：跨境信用治理是一个涉及征信、跨境数据流动和国际金融信用评级的综合性议题。从信用数据的属性切入,有助于明确跨境信用治理的底层逻辑。基于跨境信用数据的信息属性,需要以数据主体权益保护和国家安全为着力点,健全信用数据出境的规范体系;同时,在信用数据入境实践中,强化经济主体的金融风险和法律风险防范意识。基于跨境信用数据的权力属性,需要推动国内信用评级行业建设,也可在“一带一路”倡议等中国对外经贸实践中引入中国信用评级机构提供的评级,从而挑战美国评级机构在国际评级市场中的垄断地位,走出一条公正合理国际金融治理体系的中国道路。基于信用数据的信息属性和权力属性,我国可通过跨境征信实践与国际信用评级市场竞争,探索建立合理有效的跨境信用治理体系。Cross-border credit governance is a comprehensive topic involving credit collection,cross-border data flows and international financial credit ratings.Starting from the attributes of credit data helps to clarify the underlying logic of cross-border credit governance.Based on the information attributes of cross-border credit data,it is necessary to focus on the protection of the rights and interests of data subjects and national security,and to improve the regulatory system for the export of credit data;at the same time,in the practice of credit data entry,it is necessary to strengthen the prevention of financial and legal risks of economic subjects.Based on the power attributes of cross-border credit data,it is necessary to promote the construction of the domestic credit rating industry,and it is also possible to introduce the ratings provided by China's credit rating agencies into China's foreign economic and trade practices,such as the Belt&Road Initiative,so as to challenge the monopoly of the U.S.rating agencies in the international rating market,and to walk out of a fair and reasonable international financial governance system.Based on the information and power attributes of credit data,China can compete in the international credit rating market through cross-border credit collection practices and explore the establishment of a reasonable and effective cross-border credit governance system.
