法之确定性的荀韩理路及当代价值

摘　　要：法的确定性问题是法治能否实现的关键,关于中国传统法是否具有确定性的讨论亦旷日持久。荀子的法简省而不周延,主张以“治人”的能动作用“使法遍”,建立起确定性之治。韩非子的法是国家制定法,在法的制定环节中追求完备、稳定,在法的适用环节中远人、去智、一断于法,如此三重保障层层强化了法的确定性。荀、韩皆从人与法的关系视域讨论法的确定性。当代应对法的不确定性依然是法治的基本课题,荀、韩思考此问题的底层逻辑可以为解决当代法治困境提供一系列借鉴和启示。The certainty of law is the key to the realization of the rule of law,and the discussion on whether traditional Chinese law is certain has also been protracted.Xunzi's law is simple but not exhaustive,and he advocates that the“rule of man"should be used to"make the law pervasive,”so as to establish the rule of certainty.Han Feizi's law is a law enacted by the state,and he pursues a complete and stable law,far from people and wisdom in the judicial system,and strictly adjudicated by law,which is a triple guarantee that strengthens the certainty of the law layer by layer.Xun and Han both discussed the certainty of law from the perspective of the relationship between human and law.Contemporary response to the uncertainty of the law is stil the basic issue of the rule of law,Xun and Han thinking about the underlying logic of this issue can provide a series of reference and warning for solving the contemporary dilemma of the rule of law.
