中医药传统知识登记制度的现实需求与实践路径

摘　　要：由于在保护理念、保护对象及保护方法上存在制度覆盖上的局限,在行政法领域,当前我国有关中医药传统知识的保护制度尚难以完全满足其保护需求。鉴于此,尝试设计并完善适应中医药传统知识特征且满足其保护需求的登记制度成为我国在该领域面临的新任务。该制度的提出,在为中医药传统知识提供数据化保护手段的同时,也为拓宽中医药的行政保护类别提供了新路径。目前我国的中医药传统知识登记制度仍处在论证阶段,可从细化登记客体的类别、建立科学的知识审核评价机制、加强对传统知识持有人的权利保障等方面入手,以促进其进一步完善。In the field of administrative law,the current protection system of traditional knowledge of Chinese medicine in China has limitations in the concept of protection,the object of protection and the method of protection,and it is difficult to fully meet the protection needs of traditional knowledge of Chinese medicine.Taking this as a starting point,it is a new task for China to try to design and improve a registration system that is adapted to the characteristics of traditional knowledge of Chinese medicine and meets its protection needs.While the registration system provides a means of data-based protection for traditional knowledge of Chinese medicine,it also provides a new path to broaden the category of administrative protection of Chinese medicine.As it is still in the demonstration stage of system improvement,there is still room for further adjustment of the registration system of traditional knowledge of Chinese medicine in terms of content design and operational rules,and it is suggested to improve it in the three aspects of refining the object of registration,establishing an audit and evaluation mechanism,and strengthening the protection of the rights of holders.
