农村集体经济组织成员身份界定标准研究--基于20省份政策文本的量化分析

摘　　要：界定农村集体经济组织成员身份是农村集体产权制度改革、发展新型农村集体经济的基础。本文采用政策文本量化分析法对农村集体经济组织成员身份界定标准地方规范性文件进行分析,研究发现,成员身份界定标准的形成逻辑为以法律政策为依据,家户制与共同体利益为基础,社会保障为本质,村民自治为程序;不足之处有过分考量户籍标准阻碍户籍制度改革与城镇化发展,被广泛考量的常住户与权利义务标准适用性低,部分界定标准与法规政策不协调。建议基于平等原则,优先考虑社会保障标准,重点考量特定身份关系标准,弱化对户籍及权利义务标准的考量,审慎使用自治程序以完善成员身份界定标准的地方规范性文件,并抓紧落实地方性法规。对一般性群体中初始取得采用户籍+社会保障+特定身份关系标准,法定取得采用社会保障+特定身份关系标准,申请取得采用程序性标准;特殊性群体采用社会保障+特定身份关系标准。Defining the membership identity of rural collective economic organizations is the basis for the reform of rural collective property rights and the development of new-type rural collective economy.This paper uses the policy text quantitative analysis method to analyze the local normative documents on the standard for defining the membership identity of rural collective economic organizations.The research findings show that the formation logic of the membership identity definition standard is:based on legal and policy regulations,the household system and common interest,social security as the essence,and villager autonomy as the procedure.The shortcomings include:excessive consideration of the household registration standard hindering the reform of the household registration system and urbanization development,widespread consideration of the standard for permanent residents and their rights and obligations with low applicability,and some definition standards being inconsistent with laws and policies.It is suggested that the standard for defining the membership identity of rural collective economic organizations should be based on the principle of equality,giving priority to the social security standard,focusing on the standard for specific identity relationships,weakening the consideration of household registration and rights and obligations standards,using the autonomy procedure with caution to improve the local normative documents on defining the membership identity of rural collective economic organizations,and promptly implementing local regulations.For general groups,the initial acquisition of membership should adopt the standards of household registration,social security,and specific identity relationships;the legal acquisition should adopt the standards of social security and specific identity relationships;and the application for membership should adopt procedural standards.For special groups,the standards should be social security and specific identity relationships.
