私有财产处分权与绿色原则的法理冲突与解决——兼谈对食品浪费现象的认识

摘　　要：以食品浪费行为为例,对私有财产处分权与绿色原则关系进行深入研究。首先,界定食品浪费行为并探寻食品自由处分行为的法理依据;其次,探究私有财产处分权与绿色原则的法理基础;再次,分析私有财产处分权与绿色原则的法理冲突;最后,寻找私有财产处分权与绿色原则冲突的解决途径。解决私有财产处分权与绿色原则的法理冲突,有利于引导人们在绿色原则限制下行使私有财产处分权,进而寻求保护私人财产处分权与环境公共利益之间的平衡。Taking food waste Phenomenon as an example, this paper conducts an in-depth study on the relationship between the right to dispose of private property and green principles. Firstly, it defines the food waste behavior and explores the legal basis of food disposal behavior. Secondly, it investigates the legal basis of the right to dispose of private property and green principles. Thirdly, it analyzes the legal conflicts between the right to dispose of private property and green principles. Finally, it proposes solutions to the conflicts between the right to dispose of private property and green principles. Resolving the legal conflicts between the right to dispose of private property and green principles is conducive to guiding individuals to exercise the right to dispose of private property within the restriction of green principles, thereby achieving a balance between protecting the right to dispose of private property and the public interest of the environment.
