完善粮食安全法律体系的策略与路径研究

摘　　要：粮食安全法律体系的完善并非可以一蹴而就,应以增强粮食安全治理体系和治理能力为核心,坚持党的领导、人民至上、以宪法为核心等原则,遵循从粮食安全“产购储加销”全链条、粮食安全资源条件保障与促进条件保障等具体之处的完善策略,通过综合立法和单行立法相结合、国内立法和国际规则法律相结合等多种形式,从保障安全、规避风险、化解危机、救济保全等多维度发力,不断完善粮食安全法律体系。具体建议是:一是贯彻落实粮食安全保障基本法,完善相关配套法律法规;二是全面筑牢耕地法治保护屏障,统筹整合编纂《土地法典》;三是依法惩治危害粮食生产犯罪,新增危害粮食生产安全罪;四是依法守护管好“天下粮仓”,夯实粮食购销领域保障立法;五是坚决依法杜绝粮食肆意浪费,创新理念加强粮食节约立法;六是主动接轨国际规则和法律,丰富国际粮食安全合作立法;七是落实粮食安全党政同责要求,优化粮食安全党政同考机制;八是强化检察院法律监督职责,明确把粮食安全纳入公益诉讼。The refinement of the legal system for food security cannot be achieved overnight,and should be centered on enhancing the governance system and capacity of food security,adhering to the principles of party leadership,putting the people first,and taking the constitution as the core.The improvement strategy should systematically address specific aspects spanning the entire food supply chain—"production,procurement,storage,processing,and marketing"—while reinforcing resource condition guarantees and promoting supportive safeguards.This can be achieved through a combination of comprehensive and specific legislation,integrating domestic laws with international legal norms.Efforts should be made from multiple dimensions including ensuring safety,avoiding risks,resolving crises,and providing relief and preservation,to continuously improve the legal system for food security.Specific recommendations are:firstly,to implement the fundamental law on food security and refine the relevant supporting laws and regulations;secondly,to comprehensively fortify the legal protection barrier for arable land and to systematically integrate and codify the"Land Code";thirdly,to legally penalize crimes against food production and create new crimes against food production safety;fourthly,to legally safeguard and manage the"granary of the nation",and to strengthen legislation in the field of grain purchase and marketing;fifthly,to resolutely eradicate wanton food waste in accordance with the law and to enhance legislation on food conservation through innovative conceptual approaches;sixthly,to proactively align with international regulations and legal frameworks,thereby enriching legislative initiatives for international cooperation on food security;seventhly,to implement the principle of joint Party-government responsibility for food security and optimize the collaborative Party-government assessment mechanism for food security governance;eighthly,to strengthen the legal supervision responsibilities of the Public Prosecutor's Office an
