困境未成年人救助的检察介入路径探析——以预防违法犯罪为视角

摘　　要：近年来,未成年人违法犯罪问题日益突出,成为日益严重的社会问题。未成年人违法犯罪的原因包括心理习性影响、网络信息侵蚀、家庭监管缺位、学校教育存在偏颇等。其中涉及生存、发展、教育、安全等方面的困境是诱发未成年人违法犯罪的重要因素。检察机关应以最有利于未成年人原则为指引,立足新时代的检察职能行使,主动介入支持困境未成年人的生活,同时联动公安机关、民政部门等各方力量,推动困境未成年人群体的救助工作形成线索发现、工作转介、督促落实、跟踪回访的闭环工作体系模式,为困境未成年人及时纾困解难。In recent years,the juvenile delinquency,which has got increasingly highlighted,has become a serious social problem.The reasons for juvenile delinquency include the psychological and habitual influence,erosion of online information,lack of family supervision,misguided school education and etc.The problems related with survival,development,education,safety,and other aspects are important factors which contribute to juvenile delinquency.Guided by the principle of being most beneficial to juveniles and based on the performance of procuratorial functions in the new era,the procuratorial agencies should actively intervene in assisting the troubled minors'lives,and meanwhile,cooperate with various forces such as police agencies and civil affairs departments to promote the formation of a closed-loop work system model for the assistance of troubled juveniles,including clue discovery,work referral,supervision and implementation,and follow-up visits in order to provide timely assistance and solve their problems.
