摘　　要：随着数字时代的发展和全球化进程的加快,跨境数据流动已成为关键生产要素,催生出新的商业模式。跨境数据流动因涉及数据资产的跨境传输,存在个人隐私泄露、网络安全侵害甚至公共利益、国家利益损害等危险,如何平衡跨境数据自由传输和防范数据风险成为关键。本文以跨境电商这一新兴商业模式作为研究对象,系统分析跨境电商数据跨境流动面临的治理困境,并针对性地提出构建完善治理体系的对策建议,以供参考。With the development of the digital age and the acceleration of globalization,cross-border data fl ow has become a key factor of production,giving rise to new business models.The cross-border data fl ow involves the cross-border transmission of data assets,which poses risks of personal privacy leakage,network security infringement,and even damage to public and national interests.Balancing the free transmission of cross-border data and preventing data risks has become crucial.The article selects cross-border e-commerce,an emerging business model,as the research object,analyzes the governance challenges associated with cross-border data fl ow,and proposes targeted improvement measures to construct a more comprehensive governance system.
