摘　　要：公法以管制为主要目标和手段,私法以自治为价值追求,在传统法律领域中,二者泾渭分明、分庭抗礼。随着经济和社会的不断发展,公法与私法在对各自领域的社会关系进行调整的同时,也需要对相互交织的事实领域进行处理和判断,楚汉分明的公私法二元体制已难以解决社会治理体系下各种复杂的社会矛盾。《民法典》是市场经济的基本法,是构建经济社会秩序的基础性法律,确定和维护了以私法自治、契约自由精神为核心的现代社会水平关系,奠定了我国法治建设的“良法”基础。社会治理需要重塑私法的基础性地位,尽量减少国家对经济生活的干预,在民法体系内适当引入国家强制规范,通过创造性转化公法的管制手段,实现私法对市场交易成本及社会行为风险的控制,达到社会治理公正和效率的动态平衡。Public law primarily focuses on regulation,while private law emphasizes autonomy as its core value.Traditionally,these two branches of law have remained distinct and operated independently.However,as economic and social development progresses,both public law and private law must not only regulate their respective domains but also address intertwined social realities.The rigid bifurcation between public and private law is no longer adequate to resolve the complex legal challenges within modern governance.The Civil Code serves as the fundamental law of the market economy and the legal foundation for economic and social order.It establishes and upholds the principles of private law autonomy and freedom of contract,laying the groundwork for China's legal framework.Effective social governance requires reaffirming the foundational role of private law by limiting excessive state intervention in economic affairs.At the same time,integrating mandatory state regulations within the civil law framework and creatively adapting public law's regulatory tools can enhance private law's role in controlling market transaction costs and mitigating social risks.This approach enables necessary adjustments and corrections within legal relationships,ensuring that order,security,and justice are upheld.Ultimately,it seeks to achieve a dynamic balance between fairness and efficiency in social governance.
