数字人民币国际化的法治困境及对策

摘　　要：数字人民币是人民币的数字化表现形式,是我国的法定数字货币。与传统货币相比,数字人民币具有安全、便捷、高效、可追溯和低成本等优势,有助于提升跨境支付的便捷性,推动人民币国际化,促进高水平对外开放,建立更加公平的国际货币体系。随着数字人民币使用场景的进一步扩大,其在国际化进程中也会面临法治困境,如多元主体权责的分配困境、技术监管风险的规制困境、监管与隐私权保护之间关系协调的困境,以及国际规则体系中跨境支付的互操性困境等。为此,应从搭建专门性的法律制度框架、构建回应性的金融监管机制、平衡监管与用户隐私权保护之间的关系、共建融贯性国际规则体系等方面,寻求相应的法治路径,以维护我国的货币主权和金融稳定,增强数字人民币的综合竞争力,强化我国的金融风险防控和应对能力。The digital RMB is the digital form of China's official currency and serves as the country's legal digital currency.Compared with traditional money,it boasts advantages such as security,convenience,efficiency,traceability,and low cost.These features enhance the convenience of cross-border payments,promote the internationalization of the RMB,facilitate high-level opening-up,and contribute to a fairer international monetary system.As the use of the digital RMB continues to expand,its internationalization process faces legal challenges,including the distribution of rights and responsibilities among multiple stakeholders,the regulation of technological risks,the balance between oversight and privacy protection,and the interoperability of cross-border payments within the international regulatory framework.To address these issues,a comprehensive legal framework should be established,along with a responsive financial regulatory system.Additionally,striking a balance between regulatory oversight and user privacy protection and fostering a cohesive international regulatory system will be essential.These efforts will safeguard China's monetary sovereignty and financial stability,enhance the competitiveness of the digital RMB,and strengthen China's ability to manage and respond to financial risks.
