刑罚适用合目的性的困境与反思

摘　　要：时代的发展彰显刑罚目的的多元,不仅是体现报应、一般威慑和公众对规范的信赖,更应凸显其补偿、教育、矫正之功能,力求刑罚适用的人道与科学。综合理论虽然为目的多元化的整合提供了思路,但针对报应、一般预防、特别预防发生冲突时如何适用刑罚并未给出具体方案。并列式综合理论通过“不变的目的”“可变的目的”以及“两个规则”贯彻限制理念,最终实现量刑均衡。并列式综合理论的规范化展开,需要在内容层面以平衡和协调报应、一般预防与特别预防三者之间的关系为基石,在理念层面以责任主义、比例原则以及刑罚个别化的适用为核心,进行细致构建,力求量刑符合刑罚的公正性要求,并为推进量刑规范化改革提供应有的理性方向。The evolution of the times highlights the diversity of purposes in criminal punishment,which should not only reflect retribution,general deterrence,and public trust in legal norms,but also emphasize its compensatory,educational,and rehabilitative functions.This approach strives to achieve humane and scientifically grounded applications of penalties.Although the comprehensive theory provides an overall idea for the diversification of purposes,it does not give a specific plan for how to apply punishment when the conflict occurs between retribution,general prevention and special prevention.Parallel synthesis theory echoes the needs of this era,and carries out the concept of limitation through“unchanging purposes”,“variable purposes”and“two rules”,finally achieving the balance of sentencing.The standardized development of the parallel synthesis theory requires meticulous construction.At the content level,it should take the balance and coordination of the relationship among retribution,general prevention,and special prevention as the cornerstone.At the concept level,it should take the application of the doctrine of responsibility,the principle of proportionality,and the individualization of penalties as the core.Through these efforts,it aims to make the sentencing meet the requirements of the fairness of penalties and provide the due rational direction for promoting the reform of sentencing standardization.
