摘　　要：我国数字经济与平台经济等新兴经济领域蓬勃发展,吸引了大批新业态从业人员加入,推动了网络主播等新就业形态的兴起,对稳定就业发挥了重要作用。数字科技的发展,不仅催生了新的就业形态,也对传统的劳动关系认定和社会治理模式提出了新的要求。当前,网络主播与直播平台之间的劳动关系认定存在判定关系否认率较高、同案不同判现象丛生、司法判决的不同认知等问题。此外,主播的自主性和灵活性使得人身从属性减弱,技术从属性的增强又增加了认定的复杂性。对此,亟须在新质生产力推动下优化社会治理体系。完善劳动关系认定标准、引入技术从属性认定标准和调整司法裁判思路等方式,既充分考虑了网络主播的实际工作情况,又兼顾了劳动法的保护原则,从而更好地保障了网络主播的合法权益。The rapid development of emerging fields such as the digital economy and platform economy in China has attracted a large number of workers in new industries,contributing to the rise of new employment forms,such as live streamers,and playing a significant role in stabilizing employment.The development of digital technology has not only led to the emergence of new forms of employment but also raised new demands for the recognition of traditional labor relations and social governance models.Currently,there are several issues in the identification of labor relations between live streamers and streaming platforms,including a high rate of denial of the existence of such relations,inconsistent judgments in similar cases,and varying judicial interpretations.Furthermore,the autonomy and flexibility of live streamers makes the personal subordination weakened,while the increased technological subordination complicates the recognition process.To address these issues,there is an urgent need to optimize the social governance system under the guidance of new quality productivity.By improving the standards for identifying labor relations,introducing standards for recognizing technological subordination,and adjusting judicial thinking,these manners considers the actual working conditions of live streamers while also adheres to the protective principles of labor law,thereby better safeguarding their legitimate rights and interests.
