摘　　要：违规违法“减假暂”是刑罚执行中的“顽瘴痼疾”,相关职务犯罪治理与其他领域职务犯罪治理同样面临着“去存量”“控增量”“防变量”的三重挑战叠加态势。“减假暂”职务犯罪主体呈现基层与管理层并存和“老虎”“苍蝇”同腐特点;犯罪方式呈现“链条式腐败”和层层穿透特点;犯罪过程呈现多层面问题交织和多场域互动特点。“减假暂”职务犯罪原因非常复杂,其中不良政治生态破坏法治环境,是违规“减假暂”产生的深层次原因;相关制度的明确性、科学性不足是形成违规“减假暂”的直接原因;有关机制的不足是违规“减假暂”发生的重要原因。面对这种形势和挑战,应以习近平法治思想为指导,以政治建设为根本,以“零容忍”态度警诫和惩治犯罪;推进体制机制和制度模式改革;厚植理想信念,构建和完善“三位一体”的“减假暂”系统治理格局。Illegal and improper practices in sentence reduction,parole,and temporary leave(“Jian Jia Zan”)are entrenched problems in the execution of penalties.The governance of such crimes related to official duties faces the same triple challenge of“reducing stock”,“controlling increments”,and“preventing variations”as other forms of corruption in public office.The offenders involved in“Jian Jia Zan”crimes come from both grassroots and management levels,exhibiting corruption by both“tigers”and“flies”.The criminal methods show characteristics of“chain corruption”and deep penetration across multiple levels.The occurrence of these crimes reveals an intersection of multifaceted issues and multi-domain interactions.The causes behind“Jian Jia Zan”corruption are highly complex.A deteriorating political environment on the legal system are deep-rooted causes,while inadequate clarity and scientific precision in relevant systems are the direct causes.Additionally,deficiencies in certain mechanisms are significant reasons for the occurrence of illegal“Jian Jia Zan”practices.To address these challenges,Xi Jinping's Rule-of-law Thought should be used as a guide,with political development as the foundation,maintaining a“zero tolerance”approach to warning against and punishing these crimes.Reform of systems and institutional models should be advanced,and idealistic beliefs should be reinforced,building and improving a“three-in-one”system of governance for“Jian Jia Zan”.
