摘　　要：监狱法走过了波澜壮阔的30年,监狱实践实现了三次重大历史性转变和飞跃,取得了历史瞩目的成绩。但是,新时代监狱实践中也出现了一些新问题,监狱法理应具有新担当、新作为。完善监狱法应当围绕四条主线:一是以改造人为宗旨,保护罪犯合法权益,督促其履行义务、遵纪守法;二是深入推进审判权和执行权分离改革,构建各机关相互配合、相互制约的刑罚执行体制;三是规范警察权力运行,健全公正执法司法体制;四是从技术层面完善监狱法的结构和内容,增强其法律实效。The prison law has witnessed magnificent achievements since promulgated 30years ago,and three major historical changes and leaps have taken place in the prison practices.However,in the new era,some new problems have also emerged,and prison law should have new responsibilities and contributions.The improvement of prison laws should revolve around main lines:firstly,with the aim of reform,protecting the legitimate rights and interests of criminals,and urging them to fulfill obligations and observe laws and regulations;Secondly,the reform of separating the powers of trial and enforcement shall be deepened and a punishment execution system shall be established where various agencies cooperate and are constrained.Thirdly,the operation of police power shall be normed and the fair law enforcement and judicial system shall be improved.Fourthly,we shall adjust the structure and content of the prison law from a technical perspective,and enhance the efficacy of law.
