数据安全治理行刑衔接问题研究

摘　　要：囿于数据侵害行为的双重违法性,在数据安全治理过程中出现了一系列的行刑衔接难题。在实体层面,主要表现为数据的分类分级标准不协调和行刑规制的行为类型不一致;在程序层面,主要表现为分散式行政监管导致案件移送困难,分离式办案模式引发行刑衔接空转。要破解数据安全治理的行刑衔接难题,应在宏观上恪守法秩序统一性原理、贯彻行刑协同治理理念。在微观上立足技术层面统一数据的分类分级标准,基于全流程安全理念完善数据罪名体系,建立统一、专门的数据安全监管委员会,推动办案模式从分离式向同步配合转变。Because of the double illegality of data infringement,there are a series of problems in the process of data security management,which are not smooth between administrative law and criminal law.At the entity level,these problems are mainly manifested as the inconsistency of data classification and classification standards,and the inconsistency of behavior types between administrative law and criminal law.At the procedural level,these problems are mainly manifested as the difficulty of transferring cases caused by scattered administrative supervision,and the idling of execution connection caused by separate case handling mode.In order to solve the problem of poor connection between administrative law and criminal law in data security governance,we should abide by the principle of unity of legal order and implement the concept of collaborative governance between administrative law and criminal law.At the micro level,it is necessary to unify the classification and classification standards of data from the technical level,constantly improve the data charge system according to the whole process security concept,establish a unified and special data security supervision committee,and promote the transformation of case handling mode from separate to synchronous cooperation.
