黄河流域生态保护和高质量发展的制度调适

摘　　要：目前,我国环境治理形成了以行政管控类、市场激励类和公众参与类为主的制度体系。对现有黄河流域生态保护和高质量发展的制度体系进行审视发现,该制度体系中三类制度占比失衡,同时各类制度本身发展亦有不足,难以满足黄河流域生态保护和高质量发展的战略要求。合理的制度体系应做到各类制度占比均衡,统摄硬法与软法的二元规制,同时兼顾预防及过程性管理的功能。为此,黄河流域生态保护和高质量发展的制度调适应在保障各类制度占比均衡的基础上,完善行政管控类制度,同时强化市场激励和社会参与类制度的实施和健全,以最终在黄河流域生态保护和高质量发展过程中形成覆盖行政、市场和社会的复合制度体系。At present,China's environmental governance has formed a system of administrative control,market incentives and public participation.A review of the existing institutional system for ecological protection and high-quality development of the Yellow River Basin reveals that there is an imbalance in the proportion of the three types of institutions in the institutional system,and at the same time the development of the various types of institutions is also inadequate,making it difficult to meet the strategic requirements of ecological protection and high-quality development of the Yellow River Basin.A reasonable institutional system should have a balanced proportion of all types of systems,and should integrate the dual regulation of hard law and soft law,and at the same time take into account the functions of prevention and process management.Therefore,the system of ecological protection and high-quality development of the Yellow River Basin should be adapted on the basis of ensuring a balanced proportion of each type of system,improving the administrative control system,and at the same time,strengthening the implementation and soundness of the market incentive and social participation system,so as to eventually form a composite system covering administration,market and society in the process of ecological protection and high-quality development of the Yellow River Basin.
