摘　　要：中国涉外民事关系法律适用法中的强制性规定在司法适用层面遇到的难题是:确定什么是强制性规定,强制性规定适用于什么样的涉外民事关系,强制性规定如何具体适用于涉外民事关系。依据统筹推进国内法治和涉外法治的理念,采取国内法和涉外法的贯通思维,对强制性规定的法教义学分析是破解上述难题的有效方法。基于国内法和涉外法的贯通一体化思维,涉外民事关系法律适用法中强制性规定是国内法中的强制性规定在涉外民事关系上的延伸和适用,该强制性规定条款是引致性条款。中国涉外民事关系法律适用法中的强制性规定是国内公法领域的强制性规定,其适用的涉外民事关系是经由民事法律行为所形成的涉外民事关系,应依据其规范目的来确定是否对涉外民事法律行为(或形成的关系)作无效处理。The difficulties encountered in the judicial application of the mandatory provisions in China's Law on the Application of Laws to Foreign-Related Civil Relations include: identifying the mandatory provisions, determining the types of foreign-related civil relations to which these provisions apply, and understanding how they should be applied. To address these difficulties, it is effective to adopt an integrated approach that combines domestic law with foreign-related law, and to conduct a legal doctrinal analysis of the mandatory provisions. Based on the integrated thinking of domestic law and foreign-related law, the mandatory provisions in the Law on the Application of Law to Foreign-Related Civil Relations can be seen as the extension and application of the mandatory provisions in domestic law to foreign-related civil relations. These provisions are essentially inductive in nature. The mandatory provisions in China's Law on the Application of Law to Foreign-Related Civil Relations are mandatory provisions of domestic public law. The foreign-related civil relations to which they apply arise from foreign-related civil relations formed through civil legal acts. Whether foreign-related civil legal acts(or the relations formed by them) should be invalidated based on the regulatory purpose.
