危险废物污染环境犯罪侦查取证路径研究

摘　　要：当前,危险废物污染环境犯罪侦查取证困境集中体现在专业队伍建设、整体工作思路、具体操作三个方面。立足于唯物辩证法问题导向和系统观念理念,结合危险废物污染环境犯罪的特点,案件线索研判应基于空间格局、产业结构、生产方式、生活方式四个维度,以首查危废许可、快锁涉案人员、早抓核心证据的逻辑规律路径和科学算定物质流、准确认定人员流、深挖锁定资金流为思路,设计侦查取证的具体操作路径。At present,the difficulties in investigating and collecting evidence for crimes of polluting environment by hazardous wastes are concentrated in three aspects:the construction of professional teams,the overall work ideas and the specific operations.Based on the problem-orientation and systematic concept of materialist dialectics,combined with the characteristics of crimes of polluting environment by hazardous wastes,the research and judgment of case clues should be based on four dimensions:spatial pattern,industrial structure,production mode and lifestyle.The specific operation paths of investigation and evidence collection should be designed with the logical law path of first checking the permits for hazardous wastes,quickly locking the persons involved in the cases and early seizing the core evidences,and the ideas of scientifically calculating the material flow,accurately identifying the personnel flow and deeply digging and locking the capital flow.
