“临时工”现象的衍生逻辑与规制进路——基于26个省级行政区508名辅警职务犯罪判决书的实证分析

摘　　要：党的二十大报告首次提出“在法治轨道上全面建设社会主义现代化国家”,而在国家治理现代化进程中,以辅警为代表的“临时工”群体是一支重要力量。随着我国经济社会转型发展的不断深入,规模庞大的“临时工”群体与不甚规范的“临时工”招录、管理体系之间的矛盾越发明显,在这一过程中滋生了职务犯罪等违法乱纪的腐败行为。本文以中国裁判文书网公开的2012~2021年26个省级行政区508名辅警职务犯罪判决书数据为样本,实证分析了产生辅警腐败现象的影响因素。结果表明,行政审批权限对辅警群体的腐败状况具有显著的正向影响。此外,市场开放程度、区域政府规模、区域法治水平及个体特征,都与辅警的腐败程度存在相关关系。进一步分析发现,上述差异主要是由招录体系不完善、行政裁量权行使不规范和廉政教育不充分等因素造成的。基于此,本文认为,针对辅警在内的“临时工”群体应当尽快建立科学化的招录体系、完善常态化的岗位教育、健全合规化的权力行使机制,并面向全社会广泛开展廉洁教育,全面推动新时代党风廉政建设高质量发展。The 20th National Congress of the Communist Party of China first proposed“comprehensively building a socialist modernized country on the track of the rule of law”.in the process of national governance modernization temporary workers,represented by auxiliary police officers,are an important force.With the continuous development of China's economic and social transformation,the contradiction between the increasingly large group of“temporary employee”and the unstandardized recruitment and management system of“temporary employee”has emerged,which breed,corruption has emerged in the form of job-related crimes and other offences in this process.This article is based on the public cases of“temporary employee”in China.This paper empirically analyzes the factors influencing the corruption of auxiliary police officers by using the data of 508 judgments of auxiliary police officers in 26 provincial-level administrative regions from 2012 to 2021,which are available on the website of Chinese Judicial Documents.The results showed that administrative approval power has a significant positive influence on the corruption status of the auxiliary police group.In addition,the degree of market openness,the size of regional government size,rule of law of the region,and individual characteristics,are all correlated with the corruption level of auxiliary police.Further analysis reveals that the above differences are mainly attributed to the imperfect recruitment system,irregular exercise of administrative discretion,and insufficient integrity education.Based on this,the analysis of this paper suggests that a scientific recruitment system should be established as soon as possible for the“temporary employee”including auxiliary police officers,regular job education should be improved,the mechanism of exercising power should be enhanced,and integrity education should be carried out widely for the whole society to promote the high-quality development of Party working style and integrity construction in the new era.
