实质性解决争议:行政协议纠纷法院调解的现状及优化路

摘　　要：最高人民法院在细化完善行政争议实质化解的相关工作举措中,明确了法院审理行政协议案件可以依法调解。但实践中,法院调解存在使用率低、形式化等问题,阻碍了其在“实质性解决行政争议”中发挥作用。原因主要在于:理论层面,受制于传统行政诉讼法理论体系的制约;制度层面,现有法律和司法解释缺乏适用的具体细化规定;实践层面,受到司法系统内部的绩效考核、当事人选择偏好等影响。建议从两个方面完善:一是理论层面,明确法院调解适用的正当性,以行政协议的契约性作为调解适用的切入点;二是实践层面,围绕合法合意的四个维度将行政协议案件进行类型化分类,在法律正义和经济效率的双重考量下,探讨法院调解的具体适用模式,实现法院调解在行政协议案件中的路径优化。The“Supreme People’s Court Provisions on Several Issues Concerning the Trial of Administrative Agreement Cases”explicitly states that courts may mediate in administrative agreement cases in accordance with the law.However,in practice,mediation faces issues such as low utilization and formalization,which hinder its role in substantively resolving administrative disputes.The main reasons lie in the following aspects:At the theoretical level,it is restricted by the traditional theoretical system of administrative litigation law;at the institutional level,the existing laws and judicial interpretations lack specific and detailed applicable regulations;at the practical level,it is influenced by the internal performance assessment in the judicial system and the preference of the parties involved.Therefore,it is recommended to improve in two aspects:Firstly,at the theoretical level,clarify the legitimacy of court mediation,using the contractual nature of administrative agreements as the starting point for mediation application.Secondly,at the practical level,categorize administrative agreement cases based on the four dimensions of lawful consensus,under the dual considerations of legal justice and economic efficiency,explore the specific application mode of court mediation,optimize the specific handling paths for the application of mediation in administrative agreement cases.
