摘 要:小区业主共有资金保值增值是“都市中国”时代社会治理的新生难题。这事关业主的核心利益,但当下管理中存在因管理不善和现有制度束缚导致的双重堵点,成效较低,需要民间智慧的补充。在正式制度缺位的情况下,以北京、成都等地为代表的部分小区自主探索,引入信托机制管理业主共有资金,取得了良好效果。目前,业主共有资金的信托管理模式仍然处于民间探索阶段,但该模式的普遍化具有坚实的理论基础和切实的可操作性。因此,探究如何完善和固化业主共有资金管理的信托模式,是纾解业主共有资金保值增值难题的有效路径。The management of shared funds by property owners is not only related to their core interests,but also an important part of social governance.The existing fund management faces dual obstacles of management practices and institutional constraints,leading to concerns a-bout preservation and weak appreciation.The folk explorations in Beijing,Chengdu and other places have shown that introducing trust mechanisms to manage shared funds in different regional and community backgrounds can achieve professionalization,efficiency and security in property management,providing rich experience and inspiration for solving financial management problems.Therefore,based on the theoretical foundation of exploring the universalization of the owner shared fund trust model,exploring how to solidify the owner shared fund trust management model is an effective way to alleviate the problem of preserving and increasing the value of owner shared funds.
