传统村落保护立法的实践反思与路径完善——基于30份地方立法文本的实证分析

摘　　要：梳理传统村落保护地方立法现状,发现地方立法存在立法目的和保护原则价值引领不彰、分级名录保护制度不完善、规划制度不科学、发展利用制度不健全、村民主体地位不突出、多元化救济制度不充分等突出问题。充分认识地方立法保护传统村落的价值和优势,理应加强地方立法,在立法目的中融入社会主义核心价值观;确立活态传承、突出特色、政府主导、村民主体的保护原则;完善分级名录保护制度、科学衔接保护规划制度、加强市场和社会参与的发展利用制度、完善村民主体地位保护和多元化救济制度。This paper offers a comprehensive review of the current state of local legislation pertaining to the protection of traditional villages.It identifies significant issues within local legis-lation,including the lack of clear legislative purposes and guiding principles,an imperfect hierarchical directory protection system,unscientific planning mechanisms,incomplete systems for development and utilization,a lack of emphasis on the central role of villagers,and insufficiencies in diversified relief systems.In light of recognizing the value and advantages of local legislation in safeguarding traditional villages,there is a compelling need to strengthen local legislation by integrating socialist core values into the legislative purpose.Furthermore,the paper proposes the establishment of protection principles that highlight active heritage preservation,distinctive features,government leadership,and the pivotal role of villagers.This should be accompanied by enhancements to the hierarchical directory protection system,the strategic alignment of protection planning systems,the strengthening of development and utilization systems with broader market and social involvement,and improvements to villagers’status and diversified relief mechanisms.
