少数民族地区民间调解的治理转型与秩序再造——以凉山彝族自治州“德古”调解为例

摘　　要：少数民族地区民间调解的治理过程中所固有的独特特征,不能被简单地否定或肯定,而应当在实践中不断地进行取舍与调适。凉山彝族自治州的民间调解是以世俗权威的“德古”调解为中心。在现代性的社会变革背景下,“德古”的传统内涵和特征都已随着时代发展而变化。当前凉山彝族地区采取了“二元交互”的协同治理策略,为国家行动与少数民族活动形成良性的治理秩序提供可能。但是,该策略面临身份功能定位模糊、制度设计与现实需求脱节,以及成效与制度预期差距明显的问题。应当将“德古”民间调解作为凉山特有的地方性文化,通过结构主义的法律多元角度把握微观社会秩序,在立足传统文化的同时,追求现代化法治保障,促进良性的共融秩序生成。由此,可克服“二元交互”协同治理的运行力不足问题,进而实现德治与法治的协同共治。The unique characteristics inherent in the governance process of civil mediation in minority areas cannot be simply denied or affirmed,but should be constantly selected and adjusted in practice.The civil mediation of Liangshan Yi Autonomous Prefecture is centered on the“Degu”mediation of secular authority.Under the background of modern social change,the traditional connotation and characteristics of“Dragu”have changed with the development of The Times.At present,the Liangshan Yi area adopts the cooperative governance strategy of“dual in-teraction”,which provides the possibility for the formation of a benign governance order between national actions and minority activities.However,this strategy is faced with the problems of fuzzy identity function positioning,disconnection between system design and actual demand,and obvious gap between effectiveness and system expectation.We should take“Degu”civil mediation as the unique local culture of Liangshan,grasp the micro-social order through the legal pluralism of structuralism,and pursue the modern legal guarantee while basing on the traditional culture,so as to promote the formation of a benign inclusive order.Therefore,it can overcome the problem of insufficient operation power of“dual interaction”collaborative governance,and then realize the collaborative governance of virtue and rule of law.
