清末龙胜壮族习惯法权威性的生成逻辑及其当代启迪——以龙脊壮寨潘日昌案为切入点

摘　　要：习惯法权威性的确立,体现为村民对习惯法的普遍尊重与服从,这是形成地方治理秩序的重要基础。龙脊壮寨潘日昌案以其完备的民间文书记录,清晰展现出清末龙胜地区壮族习惯法权威性生成的内在逻辑。清末龙胜壮族习惯法权威性得以生成彰显,在于其根植村民对地方安宁秩序和美好生活的期待,达致国家律法、民间礼俗和民众公意有效联结,并以规范程序和多元主体为效力实现外在保障,呈现出“价值共识——规范型塑——实践保障”的逻辑进路。要提升当代习惯法权威性,应当在新时代“三治融合”乡村治理体系要求下,以村民的利益追求为目标旨归,以情理法相统一为规范依托,以落实惩罚性规条为强制保障,调适国家法与习惯法的内在张力,推动对习惯法的盘活与发展,最终实现以“两个结合”促进乡村治理现代化。The establishment of the authority of the customary law embodies the villagers’universal respect and obedience to the customary law,which is the important foundation of forming the local governance order.The Pan Richang case in Longji Zhuang village,with its complete record of folk documents,clearly shows the internal logic of the authoritative generation of Zhuang customary law in Longsheng at the end of the Qing dynasty.At the end of the Qing dynasty,the authority of the Zhuang People's customary law in Longsheng was manifested by the villagers’expectation of local peace,order and a good life,and the effective connection between the state laws,folk customs and the public will,and take the standard procedure and the pluralistic subject as the effect to realize the external guarantee,presents the logical approach of“Value consensus-standard molding-practice guarantee”.In order to enhance the authority of contemporary customary law,we should aim at the villagers’interests and rely on the unity of emotion,reason and law as the criterion under the requirements of the“Three-governance integration”rural governance system in the new era,taking the implementation of punitive regulations as the compulsory guarantee,it adjusts the inherent tension between national law and customary law,realizes the activation and development of customary law,and finally realizes the“Two combinations”to promote the modernization of rural governance.
