中国习惯法研究回顾与展望(1998-2022)——基于CSSCI数据库的CiteSpace可视化分析

摘　　要：为厘清习惯法研究脉络,把握研究的科学发展规律并加强学科认识,以CSSCI数据库中收录的816篇中国习惯法研究期刊论文作为研究样本,采用文献计量法并利用Citespace5.7.R2软件,绘制习惯法研究知识图谱。通过研究文献的时空分布、作者合作网络、核心机构、期刊、关键词共现和突显指标综合表征了习惯法研究的“社会网络”、研究热点和未来趋势与展望。结果表明,中国习惯法研究:(1)分为萌芽期、发展期和平稳期三个阶段;(2)虽然形成了一批核心研究机构,但机构间跨区域合作极少;(3)尚未形成严格意义上的核心作者群,作者间的合作并不紧密,呈现近邻性、单一性等特征;(4)二十余年间,先后涌现了习惯法的法律文化、民族习惯法、环境习惯法和社会治理等研究热点。未来亟待注重研究作者和机构的交流与合作,在研究内容上进行深入和重构,尝试以整体论的视角对中国习惯法研究理论和方法论进行补足,构建统一的研究范式,并重点关注《民法典》视阈下的习惯法司法适用理论研究、乡村社会治理习惯法、民族和生态习惯法4个研究主题。In order to clarify the context of customary law research,this paper takes 816 customary law research journal papers from CSSCI database as research samples,adopts bibliometric method and uses Citespace5.7.R2 software to draw the knowledge map of customary law research.Through the spatiotemporal distribution of research literature,author cooperation network,core institutions,journals,keyword co-occurrence and highlighting indicators,the“social network”,research hotspots,future trends and prospects of Chinese customary law research are comprehensively expressed.The results show that:(1)the research of Chinese customary law can be divided into three stages:the begining stage,the development stage and the stable stage;(2)Although a number of core research institutions have been formed,cross-regional cooperation among them is rare;(3)The core group of authors has not been formed in a strict sense,and the cooperation between the authors is not close,showing the characteristics of singleness;(4)In the past two decades,there have emerged many research hotspots such as the legal culture of customary law,ethnic customary law,environmental customary law and social governance related to customary law.In the future,it is urgent to strengthen the exchanges and cooperation between authors and institutions,deepen and reconstruct the research content,try to supplement the theory and methodology of customary law research from the perspective of holism,construct a unified research paradigm,and focus on the theoretical research of the judicial application of customary law,the governance of rural society using customary law,and the ethnic and ecological customary law.
