摘 要:非法生产、销售窃听、窃照专用器材行为助长偷拍、偷录等违法犯罪滋生蔓延,具有严重的社会危害性,应依法予以规制。由于刑法第二百八十三条规定较为简单,司法解释、规范性文件尚未出台,导致实践中难以适用该罪名并衍生出类案不同判问题。该罪“非法”是行政许可阻却违法性的特殊情形,内涵是“未经国家有关部门许可”。供应商提供核心配件、核心技术、其他商家代发货等行为均对法益造成侵害,可以认定为“生产”“销售”行为。存在退货、刷单行为时,需要结合具体案情,准确认定犯罪数量、金额。窃听、窃照专用器材具有隐蔽性、功能性、技检性,可依据不同数量、类型确定鉴定方法及内容。该罪的追诉标准应充分考量器材数量、违法所得、危害结果等要素。The unlawful producing and selling of special equipment for eavesdropping and secret photographing facilitates the breeding of candid filming and secretly recording,which has serious social harm and should be regulated by law.However,due to the simplicity of Article 283 of the Criminal Law and the lack of judicial interpretations and normative documents,it is difficult to apply this crime in practice and has led to the problem of different judgments in similar cases.The crime of"unlawful"is a special case where administrative permission negates criminality,and its connotation is"without obtaining permission from relevant state departments."The provision of core components,core technologies,and other merchants'delivery of goods all pose a threat to the legal benefits,and can be considered as"producing"and"selling".When there are returns and fake orders,the specific case should be considered to determine the crime quantity and amount.The special equipment for eavesdropping and secret photographing has a high degree of concealment,functionality,and technical inspection,and can be determined by different quantities and types of identification methods and content.The prosecution standards should fully consider the factors of equipment quantities,illegal gains and harmful consequences.
