私权力视域下平台自治的法律规制

摘　　要：在平台自治过程中,平台逐渐掌控了私权力,因此对平台自治法律规制实为对平台私权力的法律规制。在私权力视域下,我国平台自治的法律规制体系,存在平台审核责任过于刚性、平台私权力规制与激励机制的缺乏、平台自治的监管机制不完备等问题。对此,立法应限缩平台内容审核义务,合理界定其识别、发现非法内容的标准以及采取相关措施的情景与范围;对平台私权力的实施,应要求平台提高信息披露水平、完善内容审核规则、审慎实施内容限制措施、妥善处理平台用户争议;明确监管部门及其监管职责,建立健全平台危机的应对机制及超大型平台违规的特殊监控机制,明晰监管部门检查及执法权限,科学制定平台的分类分级标准并完善平台的违规责任。最终,促进平台自治与政府监管之间公私合治的良性互动。In the process of platform autonomy,the platform gradually controls private power.Therefore,the legal regulation of platform autonomy is actually the legal regulation of platform private power.From the perspective of private power,the legal regulation system of platform autonomy in my country has problems such as too rigid platform review responsibility,lack of platform private power regulation and incentive mechanism,and incomplete platform autonomy supervision mechanism.In this regard,legislation should limit the platform's content review obligations,reasonably define its standards for identifying and discovering illegal content,and the scenarios and scope of taking relevant measures;for the implementation of platform private power,the platform should be required to improve the level of information disclosure,improve content review rules,prudently implement content restriction measures,and properly handle platform user disputes;clarify the regulatory authorities and their regulatory responsibilities,establish and improve the response mechanism for platform crises and the special monitoring mechanism for violations of super-large platforms,clarify the inspection and law enforcement powers of regulatory authorities,scientifically formulate the classification and grading standards of platforms and improve the platform's violation responsibilities.Finally,promote the benign interaction between platform autonomy and government supervision in public-private governance.
