非政府公共组织的行政法规制

摘　　要：伴随着我国经济改革和社会转型,非政府公共组织发展迅猛,承担着发展经济、公共服务和自治管理等广泛的公共行政职能。然而,传统行政法以秩序行政为中心,重视行政机关及行政权力,对非政府公共组织及公共行政活动缺乏应有关注。鉴于非政府公共组织在公共行政中的重要地位,需要明确其独立的公法主体地位,并全面纳入行政法的调整范畴。要从行政组织法、行政作用法和监督及救济法三个方面考虑非政府公共组织的法律制度建构,如非政府公共组织的设置制度、公共事业与公共服务制度、扩展监督与救济法制度等。还需要行政法学界从学理上作出积极回应,对非政府公共组织进行兼容性和特别化研究,推动行政法理论体系的转型和发展。Along with China's economic reform and social transformation,non-governmental public organizations have developed rapidly,assuming a wide range of public administration functions such as economic development,public service and self-governance.However,traditional administrative law focuses on order-based administration and pays attention to administrative organs and administrative power,but lacks due attention to non-governmental public organizations and public administration activities.In view of the important position of non-governmental public organizations in public administration,there is a need to clarify their status as independent subjects of public law and to bring them fully into the scope of administrative law.It is necessary to consider the construction of the legal system of non-governmental public organizations from three aspects:the law on administrative organizations,the law on the role of the administration,and the law on supervision and remedies.Such as non-governmental public organizations set up system,public utilities and public service system,expanding supervision and relief law system and so on.It is also necessary for the administrative law community to make a positive response from a doctrinal point of view,to study the compatibility and specialization of non-governmental public organizations,and to promote the transformation and development of the theoretical system of administrative law.
