摘　　要：在中国式现代化、数字中国建设和社会治理数字化转型背景下,对数字检察的内涵和外延需要在理论上不断深入研究。对标数字中国建设和《中共中央关于加强新时代检察机关法律监督工作的意见》要求,对标社会治理数字化转型方向和数字检察的现实需求,对数字检察的认识,应回归中国式现代化、数字中国建设背景中深化;应基于检察权内涵,以及数据赋能的广度和深度来界定;应当从数字检察本体、数字检察的核心要素、数字检察运行体系三个方面展开。由此数字检察是以数据要素驱动检察履职方式、运行体系的系统性、革命性重塑,是涵盖四大检察履职以及党务、政务、队伍建设等在内的检察工作全方位、立体式数字化转型。在建设路径上,围绕数据生产与采集、汇聚与治理、应用与赋能的数据全生命周期推进建设,同时从组织架构、制度供给、运维体系、安全防范、队伍建设等方面完善数字检察配套运行体系,支撑数字检察建设行稳致远。In the context of Chinese-style modernization,the construction of Digital China,and the digital transformation of social governance,the connotation and extension of digital prosecution need to be continuously explored and studied theoretically.Aligned with the requirements of Digital China construction and the"Opinions of the CPC Central Committee on Strengthening Legal Supervision by Procuratorial Organs in the New Era,"as well as the direction of social governance digitalization and the practical needs of digital procuratorial reform,the understanding of digital procuratorial work should be deepened within the context of Chinese-style modernization and Digital China construction.Its definition should be grounded in the essence of procuratorial power and the breadth/depth of data empowerment,while being analyzed through three dimensions:the ontology of digital procuratorial work,its core elements,and its operational system.Digital procuratorial work represents a systemic and revolutionary restructuring of procuratorial functions and operational mechanisms driven by data elements.It encompasses comprehensive digital transformation across four major prosecutorial functions(public interest litigation,criminal,civil,and administrative prosecutions),as well as Party affairs,administrative operations,and team building.In terms of the construction path,the development should focus on advancing the entire data lifecycle,including data production and collection,aggregation and governance,as well as application and empowerment.Simultaneously,supporting systems including organizational structure,institutional frameworks,operational mechanisms,security safeguards,and talent development need refinement to ensure the steady and long-term advancement of digital procuratorial construction.
