贿赂犯罪罪刑关系的司法困境及解困路径

摘　　要：党的十八大以来,我国反腐败工作取得巨大成效,不敢腐、不能腐、不想腐的体制机制逐步建立健全,反腐败高压态势基本形成,但在个别领域职务犯罪仍然屡禁不止。为进一步发挥刑法在新时期反腐败斗争中的功效和作用,《刑法修正案(十二)》针对贿赂犯罪作出了一系列的修改和完善。经过这次调整,贿赂犯罪的罪刑关系着重突出和体现了党中央“受贿行贿一起查”的政策方略。由于贿赂犯罪自身存在的特殊性,导致其罪刑关系在司法实践中遭遇诸多困境,直接影响到贿赂犯罪的刑法规制效果。在对贿赂犯罪进行解释和适用过程中,通过价值判断的整合作用、刑事政策的介入以及类型化思维的运用,实现贿赂犯罪由形式解释向实质解释的转变,是解决贿赂犯罪罪刑关系的司法困境的有效途径。Since the 18th National Congress of the Communist Party of China,China has made great achievements in anti-corruption work,and the institutional mechanisms of“not daring to be corrupt,not being able to be corrupt,and not wanting to be corrupt”have been established,and the high-pressure situation of anti-corruption has basically taken shape.However,duty-related crimes in individual fields are still repeated despite repeated prohibitions.In order to further leverage the role of criminal law in the anti-corruption struggle in the new era,the Criminal Law Amendment(Ⅻ)has revised and improved the relationship between crimes and punishments for bribery crimes.The revised bribery crimes have more prominently implemented the Party Central Committee’s decision and deployment of“investigating both bribery and bribe-giving”.This paper starts from the basic concepts and characteristics of the relationship between crimes and punishments,then explains the relationship between crimes and punishments in bribery crimes,and then deeply analyzes the judicial dilemma of the relationship between crimes and punishments in the current judicial status of bribery crime investigations.Finally,it proposes solutions from the perspective of criminal law interpretation.
