数字政府背景下行政备案监管的法治化调适

摘　　要：数字政府背景下,行政备案监管制度的实施效果有待优化。行政备案监管的运行现状表现为行政机关实施的行政备案监管转向数据化、公众参与的行政备案监管走向实质化。数字技术应用视域下,面对极具效率价值追求的行政备案监管机制,现有法治架构显然无法很好应对。在行政机关实施的行政备案监管层面,存在备案监管数据的共享应用面临组织法阻碍、冲击行政相对人个人信息权利的法治化问题;在公众参与行政备案监管层面,则生成了数据协助义务规定模糊、政府回应规则不健全的难题。理应在制定《行政备案条例》的基础上,优化行政机关实施行政备案监管的组织法制度以及相关行权依据、程序机制,并完善公众参与行政备案监管的数据协助义务、政府回应规则。Under the background of digital government,the implementation effect of administrative filing supervision system needs to be optimized.The current situation of administrative filing supervision shows that the administrative filing supervision implemented by administrative organs has turned to data and public participation.From the perspective of digital technology application,in the face of the highly efficient value pursuit of administrative filing supervision mechanism,the existing rule of law framework is obviously unable to cope well.At the level of administrative filing supervision implemented by administrative organs,there are problems of the rule of law that the application of filing supervision data sharing faces the obstruction of organic law and the application of filing supervision data sharing impacts the personal information rights of administrative counterparts.At the supervision level of public participation in administrative filing,the problem of fuzzy data assistance obligation and imperfect government response rules is generated.On the basis of formulating the Regulations on Administrative Filing,it is necessary to optimize the organic law system for administrative organs to implement administrative filing supervision,as well as the relevant exercise basis and procedure mechanism,and improve the data assistance obligation and government response rules for public participation in administrative filing supervision.
