摘  要:在互联网经济快速发展的时代背景下,在体育赛事直播产业迅速发展的同时,非法盗播、转播侵权纠纷多发,关于体育赛事直播画面法律属性认定和保护模式的选择,我国学术界和法实务界存在着较大争议。为促进产业发展,总结出当前实务中体育赛事直播画面著作权保护存在的困境在于保护模式多样导致司法适用任意性大、广播组织权主体范围狭隘不利于权利保护。为了维护相关主体的合法权益和促进体育直播产业发展,应当明确以邻接权保护模式为主、反不正当竞争法保护模式为辅的保护模式,将网播组织纳入广播组织主体范围,并强化司法指导案例对司法适用的引领作用。In the context of the rapid development of Internet economy,while the sports live broadcast industry develops rapidly,there are many disputes about illegal pirate broadcast and rebroadcast infringement.There are great controversies in academic and legal practice circles about the identification of the legal attribute of sports live broadcast images and the selection of protection modes.In order to promote the development of the industry,the dilemma of copyright protection of sports live broadcast images in current practice is summarized:the diversity of protection modes leads to arbitrary judicial application,and the narrow scope of broadcast organization right is not conducive to right protection.In order to safeguard the legitimate rights and interests of relevant subjects and promote the development of sports live broadcast industry,the protection mode should be defined with the adjacent right protection mode as the main protection mode and the anti-unfair competition law protection mode as the auxiliary protection mode,the online broadcast organization should be included in the scope of broadcast organization,and the leading role of judicial guidance cases in judicial application should be strengthened.
