论体育组织在兴奋剂治理中的优化路径

摘　　要：兴奋剂治理是一个涉及多方面的系统工程,包括政府、体育组织等。该文拟采用文献检索与规范研究相结合的方法,对当前中国体育组织在兴奋剂治理中存在的问题进行深入剖析,并在此基础上,提出将协同治理理念引入兴奋剂治理问题的对策建议。在反兴奋剂问题上,体育组织面临着地位争议、管理方法失效、仲裁制度尚不完善等问题。兴奋剂治理的协同治理要求建立一个多元主体参与、共同利益导向的协同治理机制,这对于提高体育组织的行业自律水平、共享治理成果以及保障其权利的实现具有重要意义。Doping governance is a systematic project involving many parties,including the government,sports organizations and so on.This paper intends to use a combination of literature search and normative research to conduct an in-depth analysis of the current problems of Chinese sports organizations in doping governance,and on this basis,to propose countermeasures to introduce the concept of collaborative governance into the issue of doping governance.On the issue of anti-doping,sports organizations face problems such as disputed status,ineffective management methods,and imperfect arbitration systems.Synergistic governance of doping governance requires the establishment of a synergistic governance mechanism with the participation of multiple subjects and a common interest orientation,which is of great significance for improving the level of industry self-regulation of sports organizations,sharing the fruits of governance as well as guaranteeing the realization of their rights.
