摘 要:以最大诚意、尽最大努力争取和平统一前景的同时,保留非和平方式统一的选项具有必要性与可行性。内战法理为中央政府启动非和平方式统一提供国际法依据,《反分裂国家法》规定了非和平方式统一触发的条件,国际人道法确证了非和平方式统一的适当性。为有利维护国家的主权与领土完整,保障两岸同胞的根本利益,中央政府可择机重启内战行动,在战时管制阶段对台实行直接管治以尽快结束武装冲突进入过渡状态,在战后和平重建阶段通过委任治理来恢复秩序形成和平状态,逐步重构央地关系和台湾政制,促进两岸政治一体化与社会融合发展。While striving for peaceful reunification with the greatest sincerity and the utmost effort,it’s necessary and feasible to reserve the option of taking non-peaceful means for reunification.The legal principles of civil war provide the central government with an international legal basis for choosing non-peaceful means of reunification.The Anti-Secession Law of the People’s Republic of China is a domestic legal basis for triggering non-peaceful reunification.International humanitarian law is a critical rationale for justifying the appropriateness of non-peaceful reunification.For the purpose of safeguarding China’s sovereignty and territorial integrity,protecting the fundamental interests of Chinese people on both sides of the Taiwan Strait,the central government can restart civil war operations at any appropriate time,and implement direct governance over Taiwan during the wartime control stage to end the armed conflict as soon as possible and enter a transitional state,then implement delegated governance over Taiwan to restore order and form a peaceful state during the post-war peace reconstruction stage,gradually reconstruct the central-local relationship and the political system of Taiwan Province,finally promote cross-strait political integration and social integration and development.
