摘 要:失信信息公开具有声誉惩戒和公共警告的双重功能,并具有声誉罚、公共警告和行政强制三种公开目的。实践中,失信信息公开方式分为主动公开和被动公开。对于失信信息公开的法律性质,应认定为混合行政行为,即同时属于声誉罚、行政强制和事实行为。当前,失信信息公开存在合法性不足、公开滥用、公开内容过于简略、公开程序不规范、修复机制不完善等问题,需要健全法律制度,补齐程序漏洞,明确失信信息的公开方式及内容,并健全失信信息公开的修复机制。The disclosure of dishonest information has the dual functions of reputation derogation and public warning,and has the three purposes of publicity:reputation punishment,public warning and administrative compulsion.In practice,there are two ways of disclosure of dishonest information:active disclosure and passive disclosure.As for the legal nature of disclosure of dishonest information,it should be identified as a mixed administrative act,that is,it has reputational punishment,administrative coercion and factual behavior at the same time.At present,there are problems in the disclosure of dishonest information such as insufficient legitimacy,excessive disclosure,overly brief disclosure content,non-standard disclosure procedures,and imperfect repair mechanism.It is necessary to improve the legal system,fill in procedural loopholes,clarify the disclosure method and content of dishonest information,and establish a sound repair mechanism for the disclosure of dishonest information.
