摘  要:以“数据生命周期理论”为指导,分析信用数据跨境流动各阶段可能产生的过度采集侵犯主体权益、不当存储造成数据泄露、偏差处理生成错误结论、任意传输危害综合安全等四大类型安全风险。按照“治罪与治理并重”的基本思路,充分利用刑法既有罪名,全方位建构信用数据跨境流动全阶段安全风险刑事规制方案,实现从消极惩罪到积极治理的转向。在技管结合理念的指导下,从制定信用数据特别分级指南、促进征信技术手段自我优化、建立征信行业自我反向评价机制三个方面,进一步提出未来我国信用数据跨境流动安全风险的综合治理策略。Guided by the“data life cycle theory”,this paper analyzes four major types of security risks that may occur in each stage of cross-border credit data flow,including over-collection that infringes on the subject rights and interests,improper storage that leads to data leakage,deviated processing that generates wrong conclusions,and arbitrary transmission that endangers comprehensive security.In accordance with the basic idea of“equal emphasis on crime punishment and governance”,this paper makes full use of the existing criminal law charges to comprehensively construct a criminal regulation plan for security risks in all stages of cross-border credit data flow,realizing a shift from passive crime punishment to active governance.Under the guidance of the concept of combining technology and management,this paper further puts forward a comprehensive governance strategy for security risks in cross-border credit data flow in China in the future from three aspects:formulating special grading guidelines for credit data,promoting the self-optimization of credit investigation technical means,and establishing a self-reverse evaluation mechanism for the credit investigation industry.
