摘 要:算法行政范式的关系本质是“信用治理”,法治化算法行政关系到公共部门能否诚信地认识和采用算法,关系到作为美德的算法监管与问责。算法行政风险的失信主要归因于应用算法的诚信缺失、难以信赖的委托代理关系、难以验证的决策可信度和缺乏人类的诚信美德。算法行政法治化需要重视诚信原则的治理价值,算法行政的诚信治理要在法治的轨道上,立足社会信用体系建设,在依法行政中践行诚信原则,加强既有算法监管问责制诚信建设,加强算法采购诚信建设,建立算法行政失信惩戒制。The essence of the relationship in algorithmic governance paradigms is“credit governance”.The rule-of-law-based algorithmic governance concerns whether public sectors can honestly understand and adopt algorithms,as well as algorithmic regulation and accountability as virtues.The lack of integrity in algorithmic governance primarily stems from dishonesty in applying algorithms,untrustworthy principal-agent relationships,difficulties in verifying decision credibility,and a deficiency in human virtues of integrity.The rule-of-law-based algorithmic governance requires attention to the governance value of the principle of integrity,and the governance of integrity in algorithmic governance should be on the track of the rule of law,based on the construction of a social credit system,practicing the principle of integrity in lawful administration,strengthen the integrity construction of the existing algorithm regulatory accountability system,strengthening the construction of integrity in algorithmic procurement,and establishing a disciplinary system for dishonesty in algorithmic governance.
