摘 要:为了破解“企业污染、群众受害、政府买单”的困境,实现“谁污染谁治理,谁破坏谁修复”,国家从2017年开始在全国正式实施了生态环境损害赔偿制度。在不断地探索和实践过程中,生态环境损害赔偿制度体系不断完善,各地案件办理也取得了较好的成效。由于我国生态环境损害赔偿制度起步较晚,相关经验还不足,该项制度在实施过程中还面临一些难点。本文梳理了在案件办理过程中遇到的赔偿义务人不理解、鉴定费用过高、生态修复存在困难等三个难点,并提出了相关的对策。To address the dilemma of"enterprise pollution,public suffering,and government compensation,"and to realize the principle of"polluters pay and destroyers restore,"China formally implemented the ecological damage compensation system nationwide in 2017.Through continuous exploration and practice,the system has been progressively improved,achieving significant results in case handling across various regions.However,due to the late establishment of China's ecological damage compensation system and insufficient experience,several challenges remain in its implementation.This study identifies three major difficulties encountered in case handling:lack of understanding among compensation obligors,high identification costs,and challenges in ecological restoration.Based on these findings,the study proposes relevant countermeasures.
