摘　　要：依法传承和弘扬爱国主义精神是促进人民国家认同的必然要求,也是实现人民理性爱国的有效保障。“中国”作为一个历史文化和政治法律概念的综合体,为人民爱国提供了深层的文化根源和现实的法律依据。爱国行为的法律内涵包括维护之爱、服从之爱和参与之爱。加强爱国主义法治建设,具有深刻的法理基础和制度资源:一方面,爱国主义法律义务框定了爱国行为的内容及其边界;另一方面,爱国主义立法、执法、司法及守法积聚了丰富的实践经验,但也存在诸多不足。当前,加强爱国主义法治建设,应当健全爱国主义法律规范体系、构建刚柔并济的双层爱国主义行政执法机制、积极拓展“上下联动”的爱国主义司法保障机制、以“防范风险+完善激励+包容发展”为支点健全爱国主义守法机制,最终形成制度合力,推动爱国主义法治实施和爱国主义理性发展。Inheriting and carrying forward the spirit of patriotism according to law is the inevitable requirement for promoting people's national identity,and it is also an effective guarantee for the realization of rational patriotism.“China”is a synthesis of historical culture and political-legal con-cept,and it provides deep cultural roots and realistic legal basis for people's patriotism.The legal connotation of patriotic acts includes the acts of preservation,obedience and participation.Strengthening the construction of the legal system of patriotism has a profound legal basis and institutional resources.On the one hand,the legal obligation of patriotism defines the content and boundary of patriotic behavior.On the other hand,legislation,law enforcement,justice and law-abiding have accumulated rich practical experiences,but there are also many deficiencies.Currently,we can improve the legal system of patriotism through the structural model of basic law,special law and relevant law,aiming to improve the construction of patriotic legal system.Still,it is necessary to build a rigid and flexible administrative law enforcement mechanism.Moreover,we should actively expand the judicial protection system for patriotism characterized by“top-down linkage”.Meanwhile,we can establish a law-abiding mechanism for patriotism based on risk prevention,improvement of incentives,and inclusive development.Finally,the institutional synergy is formed to realize the orderly and healthy development of patriotism.
