摘　　要：程序导向的治理路径是算法治理体系的重要组成部分。算法技术对传统的正当程序原则提出了挑战,技术性正当程序应运而生,但相关的制度建设仍有不足。主观程序正义关注人们对特定程序的感受及规律,有助于技术性正当程序的制度探索。从“算法厌恶”研究成果来看,“基于主观程序正义的技术性正当程序”这个提法是可行的,这种可行性具体包括理论结构、规范基础和研究基础三个方面。以程序赋能为目标,“基于主观程序正义的技术性正当程序”的研究路径包括:研究“算法社会中的人”,研究当事人视角的算法应用场景,坚持研究的本土化和开放化。从“基于主观程序正义的技术性正当程序”出发,建立算法程序治理的各种制度,有助于推动我国算法治理体系的完善。The process-oriented governance path is an important component of the algorithmic governance system,and algorithmic technology also poses challenges to traditional principles of due process.The concept of technological due process has emerged,but there are still deficiencies in related institutional construction.Subjective procedural justice focuses on people's perceptions of specific procedures and their patterns,which is conducive to the exploration of institutional construction of technological due process.From the perspective of“algorithm aversion”research,“technological due process based on subjective procedural justice”is feasible,and this feasibility includes three aspects:theoretical structure,normative basis,and research foundation.With procedural empowerment as the goal,the implementation path of“technological due process based on subjective procedural justice”includes:researching“persons in algorithmic society”,studying the application scenarios of algorithms from the perspective of the parties involved,and adhering to the localization and openness of research.Starting from“technological due process based on subjective procedural justice”,establishing various institutions for algorithmic procedural governance can help promote the improvement of algorithmic governance system in China.
