农业转移人口自愿有偿退出土地承包权补偿价格研究——基于土地收益还原法的分析

摘　　要：保障进城落户农民合法土地权益,鼓励依法自愿有偿转让。要以充分合理的承包地退出补偿价格,维护好农业转移人口土地权益,让农民更多分享改革红利。在第三轮承包期再延长30年的情况下,本文利用收益还原法,分别从粮食净收益、农村土地流转价格、承包剩余年限三个方面,对农业转移人口承包地退出补偿价格进行测算。研究结果发现,用粮食净收益加承包剩余年限还原法测算的退出价格较低,用农村土地流转价格加剩余年限还原法测算的退出价格具有合理性。据此,提出应依据新的《中华人民共和国土地管理法》和新的《土地管理实施条例》,结合区域经济社会发展水平,按照土地流转价格还原法测算的退出价格对有偿退地进行充分补偿,并对符合条件的退地农民安排农民养老缴费补贴的政策建议,为切实保障农民土地权益提供理论支持。This study emphasizes the importance of safeguarding the legitimate land rights of rural migrants moving to urban areas and encourages voluntary,compensated land transfer in accordance with the law.It advocates for an adequate and reasonable compensation price for withdrawing from contracted land to ensure that agricultural migrant populations can better share in the benefits of reform.In light of the extension of the third round of contracts by an additional 30 years,this paper employs the income capitalization approach to assess the compensation price for contracted land withdrawal,analyzing net grain income,rural land transfer prices,and the remaining years of contracts.Results indicate that the compensation price calculated using net crop yields and remaining years is lower,while the price derived from rural land transfer prices and remaining years exhibits rationality.Therefore,this paper proposes that,in accordance with the newly revised“Land Administration Law of the People’s Republic of China”and the new“Regulations for the Implementation of the Land Administration Law,”and taking into account the level of regional economic and social development,full compensation for paid land withdrawal should be calculated using the land transfer price capitalization method.Additionally,policy recommendations include providing pension payment subsidies for eligible farmers who withdraw from their land.This offers theoretical support for effectively safeguarding farmers’land rights and interests.
