数字化背景下算法技术影响劳动权益问题探析

摘　　要：日新月异的算法技术正在为数字经济发展全面赋能,促使劳动效率飞速提升,为人的自由全面发展创造契机。算法技术一方面能够高效破除信息壁垒,深度优化资源配置,极大提高劳动管理效率,为推动数字劳动发展发挥积极作用;另一方面,也塑造了平台企业、消费者与劳动者等多行为主体交互博弈的格局,使劳动者在这种格局中处于被动和弱势地位,进而造成劳动者的社会保障权、申诉权、劳动报酬权、自主权、休息权和健康权等合法权益受到侵害。对此,应加快构建效率与公平兼顾的算法体系,多方共治,加强对算法的精准监管,重视算法伦理教育,促进算法向善,从技术、监管和教育等层面优化算法治理策略,完善数字时代劳动者权益保障体系。The ever-changing algorithmic technology is empowering the development of the digital economy in a comprehensive way,promoting the rapid improvement of labor efficiency and creating opportunities for the free and comprehensive development of human beings.On the one hand,algorithmic technology can efficiently break down information barriers,optimize resource allocation in depth,and greatly improve the efficiency of labor management,thus playing a positive role in promoting the development of digital labor;on the other hand,it has also shaped a pattern of interactive games among multiple actors,including platform enterprises,consumers and workers,which puts workers in a passive and vulnerable position in this pattern,and in turn results in the infringement of their legitimate rights and interests,such as the right to social security,the right to appeal,the right?to obtain?remunerations?for?labor,the right to autonomy,the right to rest and the right to health.In this regard,we should accelerate the construction of an algorithmic system that balances efficiency and fairness,promote multiple actors to work together to strengthen accurate regulation of algorithms,strengthen education on algorithmic ethics,construct a more humane algorithmic system,optimize algorithmic governance strategies in terms of technology,regulation and education,so as to improve the system for protecting workers’ rights and interests in the digital age.
