数据跨境流动国内治理的理论检视与路径探究

摘　　要：随着数字密集型产业的发展,数据跨境流动逐渐成为全球贸易和投资增长的新支柱,更是推动数字经济快速发展的核心引擎。在历经隐私权、财产利益到国家主权的理念发展变迁后,私权体系下的数据保护秩序遭到破坏,被以国家主权为基础的公共秩序保护观所取代,各国开始重新探讨国内治理在数据跨境流动中的新定位。我国目前已经构筑起数据保护的基础性框架,也在不断完善国内治理规则,建立起了以主权安全为基本理念,以数据本地化储存为基础框架,融合安全评估、保护认证、标准合同等保障数据安全出境措施的新体系。实践中应以比例原则作为实施数据本地化的必要限度;兼采多元协同的监管措施,借鉴亚太经合组织“问责制”以及美国的“行业自治”进行多元化治理;同时倡导求同存异的国际合作局面,积极探索数据跨境流动新模式。With the development of digital-intensive industries,cross-border data flow has gradually become a new pillar for the growth of global trade and investment,and even a core element to promote the rapid development of the digital economy.Through the developmental changes from privacy,property interests to national sovereignty,the data protection order under the private rights system has been undermined and replaced by the public order protection based on national sovereignty,and countries have begun to re-examine the new positioning of domestic governance in cross-border data flow.At present,China has built a basic framework for data protection,and has been constantly improving domestic governance rules,thusestablishing a new system that takes sovereign security as the basic concept,and implements data exit measures such as security assessment,standard contracts,and protection and authentication under the framework of localized data storage.In practice,the principle of proportionality should be taken as the necessary limit for data localization;multiple and coordinated regulatory measures should be adopted,and reference should be made to the‘accountability system’ofAPECand the“industry autonomy”inthe U.S.for diversified governance;and by actively exploring a new model for cross-border data flow,international cooperation should be advocated in order to seek common ground while accommodating differences.
