摘　　要：夫妻共同债务的认定在婚姻法律体系中至关重要,涉及夫妻财产权益、债务责任及债权人权益保护。通过探讨夫妻共同债务的认定标准,阐述夫妻共同债务的现状,并分析当前认定标准存在的问题,如家事代理制度不健全、恶意举债与虚假诉讼频发、侵权行为债务认定难等。针对这些问题,提出建议,包括明确家事代理权范围、加强恶意举债与虚假诉讼的防范、明确侵权行为债务认定标准等。以细化法律规定、建立信息共享机制、加强部门合作等措施,为夫妻共同债务的准确认定提供有效法律路径,旨在维护家庭财产稳定,保障婚姻双方及债权人权益,促进社会和谐。The identification of marital joint debts is crucial in the marital legal system,as it involves the property rights and interests of both spouses,debt responsibilities,and the protection of creditors'rights.Through exploring the identification criteria of marital joint debts,this paper elaborates on the current situation of marital joint debts and analyzes the existing problems in the current of identification criteria,such as the incomplete domestic agency system,frequent malicious debt accumulation and collusive actions,and the difficulty in identifying tortious debts.To address these issues,this paper proposes recommendations,including clarifying the scope of domestic agency authority,strengthening the prevention of malicious debt accumulation and collusive litigation,and establishing clear standards for determining tortious debt.By refining legal provisions,establishing an information-sharing mechanism,and enhancing interdepartmental cooperation,this paper aims to provide effective legal pathways for the accurate identification of marital joint debts,so as to maintain family property stability,safeguard the rights of both spouses and creditors,and promote social harmony.
