反思与完善——未成年人刑事执行制度的科学化

摘　　要：我国目前的未成年人刑事执行制度,在立法上未能将其从成年人执行制度中独立出来进而采取差别方式教育和改造未成年人,在实践中亦存在着诸多问题,如监禁刑的适用率居高不下、未成年犯的分类制度过于简单、社区矫正的实务操作尚需细化以及犯罪前科的负面影响难以消除等。我国未成年人刑事执行应采取更为科学的方式,以体现缓和、人道的原则。建议:(一)健全未成年犯的分类制度;(二)丰富监禁刑的执行方式;(三)完善社区矫正制度;(四)建立前科消灭制度;(五)完善未成年人刑事审判工作机制,以期促进我国未成年人刑事执行制度更加科学化。The current criminal execution system for minors in China has not been separated from the adult system in legislation,making it impossible to educate and reform minors in a different way.In practice,there are also many problems,such as the high rate of incarceration,an overly simplistic classification system for minor offenders,rough community correction operations,and the difficulty in eliminating the negative impact of criminal records.The execution of criminal penalties for minors in China should adopt more scientific methods to reflect the principles of leniency and humanity.In hope of promoting the scientization of the minor criminal execution system in China,the suggestions are put forward:(1)improving the classification system for minor offenders;(2)enriching the implementation methods of incarceration;(3)perfecting the community correction system;(4)establishing a criminal record elimination system;(5)improving the minor criminal trial mechanism.
