摘 要:《中华人民共和国黄河保护法》提出建立黄河流域统筹协调机制,对黄河流域统一管理、协调发展及改善生态具有重要意义,囿于颁布时间较短,未出台相关规范性文件对统筹协调机制的具体运作模式进行规定,不利于黄河流域生态保护和高质量发展。针对统筹协调机制法律定位不明、协调内容不够细化、缺乏载体和协调限度问题,以商谈理论为方法论,出台相关法律法规或立法解释,厘清黄河流域统筹协调机制的法律定位,明确其职责权限,设立黄河流域统筹协调小组,明确协调限度,从而解决黄河流域治理中的多元利益冲突问题。The Yellow River Protection Law of the People’s Republic of China proposes the establishment of a coordinating mechanism for the Yellow River Basin,which is of great significance for the unified management,coordinated development and ecological improvement of the Yellow River Basin.Due to its recent promulgation,no normative documents have been issued to regulate the specific mode of operation of this coordinating mechanism,hindering efforts towards ecological protection and high-quality development in the basin.This study identifies several key issues,including unclear legal positioning of the coordination mechanism,insufficiently detailed coordination content,and the absence of operational carriers and limits.Drawing on negotiation theory as a methodological framework,this paper suggests introducing relevant laws,regulations,or legislative interpretations to clarify the legal positioning of the Yellow River Basin Coordination Mechanism,define its responsibilities and authorities,establish a Yellow River Basin Coordination Group,and set clear coordination limits.These measures aim to resolve the multiple and multilayered conflicts of interest in the governance of the Yellow River Basin.
